First on KING5: Judge's ruling ends Seattle's gun ban

SEATTLE - A Judge has just ruled that the city of Seattle ban on guns on city property is illegal, effectively ending the ban.

The 2nd Amendment Foundation, the National Rifle Association, and several individuals, including a gay rights activist and a Department of Corrections worker sued the City of Seattle and former Mayor Greg Nickels in October. They demanded the city repeal a controversial ban on guns in places like parks and community centers.

The individual plaintiffs say they're suing not just on principal, but because they now "fear for their safety", according to their lawsuit.

King County Superior Court Judge Gregory Canova made the ruling today after the plaintiff�s filed a motion for Summary Judgment and prevailed. :ok:

every fight right now help . it time the judges unstand what there ruling on and what it dos an how it hurts others rights . i am glad he has a level head

While this is a start, it means nothing.

Until you see this case adjudicated by SCOTUS, it doesn't set precedent.

YET.

Trust me when I tell you that this will be appealed all the way to SCOTUS.

ONCE THEY RULE ON IT, THEN WE HAVE SOMETHING TO CELEBRATE.

Hopefully.

It looks like it already has. The bill is so extreme, it has little support in the senate, even among Democrats. In WA, even dems own guns...

SCOTUS is irrelevant in this case. This city law was in contravention to the state preemption law(RCW 9.41.290), as well as the WA state constitution(Article 1, Section 24). It's an open and shut case, and has nothing to do with the second ammendment.

Well that's YOUR opinion.

I'm pretty SURE anti-gun folks don't see it that way.

THIS WILL go to SCOTUS. Hopefully we will win this one there.

If not, we have not lost anything.

Julian, no offense, but apparently you don't understand the mechanics of our current legal system. If you lose the case, you just appeal it (state supreme court). And appeal it again (FINALLY to SCOTUS).

THAT'S THE WAY THIS GAME IS PLAYED...

Snohomish county (Seattle is in King county and Snohomish is the next county to the north) actually has a ban on guns in county parks. One of the county council members tried to get that restriction removed about a month or so ago to bring county policy inline with state law but the other council members shot it down.

Based on recent experience in Georgia, I'm with Julian on this one.

Until several years ago in Georgia, the 159 counties along with hundreds more cities and municipalities were busily making an insane patchwork of firearms laws. The result was a firearms owner couldn't go ten miles in any direction without being in violation of 4 laws. As a result, Georgia passed a law stating that the State firearms laws were superior across the state and locals could not add to them or detract from them. This law sat on the books for a while but it wasn't enforced, the mess of laws were enforced. Several years ago, GeorgiaCarry.org starting collecting money and lawyers with the intent of enforcing the state law. Now, several years layer and scores of successful lawsuits later, Georgia Carry has forced local governments to drop their restrictive laws. This includes a couple of successful suits against the Atlanta City government and the largest counties in the state. The precedent has been so established that now the threat of a suit is sufficient.

The legal precedents and necessity for primacy of state above local regulation are long established.
