First on KING5: Judge's ruling ends Seattle's gun ban
by SUSANNAH FRAME / KING5 News Posted on February 12, 2010 at 4:16 PM ****** SEATTLE - A Judge has just ruled that the city of Seattle ban on guns on city property is illegal, effectively ending the ban. The 2nd Amendment Foundation, the National Rifle Association, and several individuals, including a gay rights activist and a Department of Corrections worker sued the City of Seattle and former Mayor Greg Nickels in October. They demanded the city repeal a controversial ban on guns in places like parks and community centers. The individual plaintiffs say they're suing not just on principal, but because they now "fear for their safety", according to their lawsuit. While this is a start, it means nothing.
Until you see this case adjudicated by SCOTUS, it doesn't set precedent. YET. Trust me when I tell you that this will be appealed all the way to SCOTUS. ONCE THEY RULE ON IT, THEN WE HAVE SOMETHING TO CELEBRATE. Hopefully. |

Julian, no offense, but apparently you don't understand the mechanics of our current legal system. If you lose the case, you just appeal it (state supreme court). And appeal it again (FINALLY to SCOTUS). THAT'S THE WAY THIS GAME IS PLAYED... |

Snohomish county (Seattle is in King county and Snohomish is the next county to the north) actually has a ban on guns in county parks. One of the county council members tried to get that restriction removed about a month or so ago to bring county policy inline with state law but the other council members shot it down.

The precedent has been so established that now the threat of a suit is sufficient. The legal precedents and necessity for primacy of state above local regulation are long established. |
